While spores are legal to own and study in most of the country, the same can’t be said for the fully grown mushrooms. Grown magic mushrooms contain psilocybin, a potent psychedelic that is currently regulated by the federal government as a Schedule I drug. That means it’s federally illegal nationwide to buy, sell, own, or grow magic mushrooms.
But while most states haven’t challenged that status and uphold the federal ban on magic mushrooms, Colorado is an exception. There was a years-long fight to legalize psychedelic mushrooms in Colorado that paved the way for psychedelic advocacy nationwide.
So are magic mushrooms legal in Colorado? What should I know about getting or using mushrooms? Let’s jump into everything you need to know about magic mushrooms in Colorado.
How Are Magic Mushrooms Used?
It’s important to understand how mushrooms are used before getting into Colorado’s specific legal landscape. This way, we can see why people were so passionate about getting it legalized.
- Spiritual Experiences: For thousands of years, magic mushrooms have been used by Indigenous groups during religious rites. Users would be guided by an elder through a psychedelic experience focused on spiritual growth and connection.
- Guided Therapy: Some people have integrated magic mushrooms into their therapy. Activists hoped that by legalizing psychedelic mushrooms in Colorado, more locations could start offering guided psychedelic therapy.
- Recreation: Magic mushrooms are a unique experience. They’re popularly used by many before concerts, while camping, and other events where they want to enhance connection and joy.
- Mycology: Many hobby mycologists buy mushroom spores to study magic mushroom spores, make art, and grow mushrooms of their preferred strain.
Are Magic Mushrooms Legal in Colorado?
Short answer: yes, psychedelic mushrooms are legal in the state of Colorado.
Long answer: yes, but there are a few caveats.
Magic mushrooms have been decriminalized since November 2022. That means it’s functionally legal to grow, own, and give away psychedelic mushrooms in Colorado. However, you still can’t buy or sell them. There are no “magic mushroom dispensaries” in the same way that cannabis dispensaries exist in states where marijuana is legal.
Magic mushrooms can also only be owned and used by those 21 or older. You cannot advertise, prominently display, or use magic mushrooms in public. While you can grow your own mushrooms and there is no maximum amount of inventory for personal use, you can only grow mushrooms in a 12×12 space on private property.
At first, there were no licensed therapy practices. Some organizations passionate about the power of psychedelics to stimulate mental health improvements offered guided experiences (“trips”), but they had to include a disclaimer that this was an unlicensed experience. While wellness-seekers could pay for the service, the service couldn’t be advertised as a psychedelic experience.
Starting in early 2025, however, licensed and state-regulated psychedelic therapy practices have started opening statewide. This is the first legal way to pay for psychedelic mushrooms in Colorado.
How to Stay Within the Bounds of the Law
Now that you know the details of all stipulations that came with the decriminalization of psychedelic mushrooms in Colorado, how do you make sure you’re compliant with all of them?
1. Be discreet
Just because magic mushrooms are legal in Colorado doesn’t mean you can eat mushrooms anywhere, anytime. Any mushroom consumption must happen in private. Keep it to small gatherings at your home or out in the Colorado wilderness and you’ll be good.
2. Check the background of psychedelic guides
If you’re interested in a guided trip with psychedelic mushrooms in Colorado, know that not all guides are equal. Many still aren’t regulated, which means anybody with access to mushrooms can be a guide. Check the license status, read customer reviews, and more to ensure the experience you have will be a safe and beneficial one.
3. Don’t bring mushrooms out of state
Magic mushrooms are legal in Colorado, but not many other places. Enjoy your mushrooms within state borders, but don’t cross with them. Otherwise, you’re subject to the laws of the state you’re entering, which is most likely in line with federal regulation.
